I'd guess that since he's a government employee who aided lawbreakers who then lost the fight to have that law overturned, he is now a fugitive.

Couple of things,
1st,... Happy Hogan could be considered a casualty of this war. Spymaster injured him, but Tony Stark pulled the plug using his Extrimis computer voodoo powers. He did this after a massive guilt trip by sue storm
Now to issue 7,.... my opinion was sorta weak,... I'm not tring to be a hater. It's just that the entire story line, to me, was very powerful. Some of the players, on both sides, were so deeply portrayed, I really enjoyed it. I think it would not be possible for any ending to be totally satisfying.
That being said,... Captain America DID NOT "realize he was on the wrong side" He realized continued fighting just take away from the ideals he stood for. He recognized his best and most effective stand would need to made from a cell block.
I hope that there will be a lot more resolution with "The initiative

Nutcase, if you believe for a single second that civil war was ever something good, something VERY good during execution, there is no way you could be labelled as a hater on this site I'm with you but I genuinely do think Cap knew the way he was opposing the law- through violence- was wrong, and thus he was wrong in his approach. And WELCOME ABOARD, fellow Assembler!

OK Doom, let me ask you this. What if you were in Cap's shoes.
Issue 1, you're on the helicarrier and agent Hill tells you about the registration act. Cap doesn't immediately go to lawbreaking. Then agent Hill tells him he has to hunt down the dissenters, again he doesn't immediately go to lawbreaking. Then agent Hill orders him to be taken in. Remember through Caps history with SHIELD several times he has had to oppose SHIELD. Which by the way is a WORLD level enforcement agency, not American law enforcement. SHIELDS reaction turns Cap into a fugitive.
That being said, he could have given up and fought the fight from prison earlier than he did, but again, being in Cap's shoes I ask, how would you feel? Gave up a large portion of his life for his country, can't have a normal relationship because of his devotion to his country, died repeatedly for his country( I regret that I have but 1 life to give,... oh wait this is Marvel) He does all this and gets attacked because he won't thump his friends in the skull.
How would you react?

Firstly it should be said he does have a relationship with Sharon Carter at this time. Honestly, I think I'd react as Cap did INITIALLY. But the second I got time alone, when I bust out of there and thought to myself, I honestly think I would give in- but I'd seek out and surrender to Tony rather than SHIELD, trusting him more than then.
