It's a toss up for me. I'd have to "Civil War" is probably, the best.
However, not counting that . . . I'd say "Astonishing X-Men."
Whedon has really captured the essence of the X-Men, while keep it exciting and interesting. He's really shown a lot of love for the old school material, but has been able to keep it fresh.
On the same token, Cassidy has been the perfect match for Whedon. He has a great way of creating intimate scenes when he needs to, and dynamic when called upon.
All in all, the best Marvel is pumping out right now!

I was very (positive) surprised with Brubaker´s first DD storyline (The Devil In Cell-Block D). I enjoyed Bendis´ run (for the most of it) and, of course, he lay plot-wise ground for Brubaker´s story.
But Brubaker has only a slightly new approach for Murdock´s situation (putting him even deeper into the shi...), but it´s more action-packed. That being said, Maleev´s art was very good in point of ambience but his actions scenes are very weak.
That was my second positive surprise: the art of Michael Lark - very nice work, all the beloved classical elements are there, but with a modern (and personal) touch.

Civil War, without doubt.
Not counting that.... Hmmm, difficult.
I'd have to say Captain America, but followed VERY closely by ASM. JMS can be hit and miss but right now he just keeps hitting.

It’s hard to know what is truly “best”. In terms of currently published ongoing series that make me shiver and ache all month in anticipation of the next issue and compel me to reread the latest issue (sometimes immediately after the first reading!), I guess I’d say Runaways and She-Hulk, with an honorable mention for the in-between-volumes Young Avengers. Some other series qualify to a lesser extent, e.g., Thunderbolts. And now that I’m thinking about this standard, maybe it’s time to rid my reading list of some of the titles that don’t qualify…
As for why the aforementioned titles get me feeling that way…well, I hadn’t considered it before, but all of them regularly do a nice job of characterizing a stable of varying personalities, and they also specialize in unexpected yet logical developments.

Again, there are only a handful of books I regularly purchase, but two that strike me as the Phantom describes are The Ultimates and DC's Justice. Can't-wait-to-reads, they are.

Right now both Spectacular and Friendly Neighbour SM, old classic style comics with loads of actions, forgotten villains (Swarm, Molten Man) and overall good writing

As I've posted in other threads. I'm thinking the Black Panther is up there with the best for me.
I look forward to every new issue and am very seldom dissappointed with what comes in.
